Immigration bonds are those bonds issued to post bail for a person charged with an immigration offense. Immigration bonds are similar to other bonds in that they secure bail, enabling a person charged with a crime to be released from custody. However, immigration bonds are usually more difficult and time-consuming for a bail bond agent.

Immigration bonds are posted through the U.S. Immigration & Naturalization Service (INS) instead of through a standard jail facility as other bonds are. This means that the bail bond agent must work within the limited hours of operation of the INS. In addition, a bail bond agent must have a casualty insurance license in addition to the regular license required by a bondsman. Collecting collateral, if needed, and language barriers may also be issues while acquiring an immigration bond.

If a defendant defaults on an immigration bond, meaning he or she does not appear to one or more court appearance, the entire amount of bail is immediately forfeit and is payable to the U.S. government.
