A property bond is a form of bail bond which uses real property (such as a home, condominium or other real estate) owned by the defendant or a co-signer (usually a friend or family member) in order to secure the defendant's release from custody. In the case of a property bond, the court records a lien on the property to secure the entire bail amount.
While a property bond is an option for a defendant who owns property, it is a complicated and time-consuming type of bond and is very rarely used in California. This release option actually requires prior approval by the magistrate as well as a full property profile - including, but not limited to, an appraisal. Property bonds are not offered through many states in the U.S.
In the case of a property bond, if the defendant fails to appear in court, the court may take measures to start foreclosure proceedings on the property in order to obtain the forfeited bail amount in its entirety.
