Protective Order

A protective order, or order of protection, is a legal order which restricts a person accused of emotional, physical or sexual abuse or harassment from contacting the victim. This order is usually restricted to domestic violence crimes, crimes which involve spouses, ex-spouses, family members or those people living together or who have a child together.

A protective order or temporary restraining order may be issued before court proceedings, before a trial and before a verdict has been reached. They are meant to protect the victim from further abuse while legal proceedings are in motion. Under a protective order, a person is restricted from contacting or coming into contact with the victim, usually having to stay at least 100 yards away. In some cases, the accused will have to leave the house they share with the victim, even if the accused owns the property or is paying the rent or mortgage.

Violations of orders of protection sometimes become involved in bail bond issues. If the accused violates an order of protection, he or she will usually be looking at immediate arrest, as well as a possible violation of a bail bond.
